Two Types of Divorce
There are two types of divorce in Maryland: limited and absolute divorce. An absolute divorce is a final divorce that ends your marriage. A limited divorce is more like a legal separation with court orders for issues like alimony, property division, child custody and visitation.
Except in cases of grounds such as adultery and domestic violence, Maryland requires a one-year separation period before filing for divorce. For this reason, many people find it necessary to obtain a limited divorce to protect their interests during the one-year waiting period.
It isn't necessary to obtain a limited divorce if you and your spouse can successfully negotiate a separation agreement outside of court.
